South Africa is still trying to decide whether according to its own laws online casinos are legal in the country or not. The issue revolves around whether it is where the casino server is located or where the players are located that determines the licensing requirement and the most recent casino news to come out of the country suggests that it is the players that matter. The online casino company Casino Enterprises (pty) Ltd which for some unknown reason is also referred to as Piggs Peak has its server based in Swaziland where online gambling is legal and back in 2004 at the North Gauteng High Court, they and the Gauteng Gambling Board instigated an application to find out whether this meant they were legal in South Africa but in November 2006 the North Gauteng High Court ruled in favour of the Gauteng Gambling Board stating that the interactive gambling games offered in Gauteng required a licence. Piggs Peak appealed the decision which was then referred to Bloemfontein only for it later to be referred back to Gauteng which resulted in the recent decision that Piggs Peak was operating illegally. The operations director of Piggs Peak Mr Lew Saul Koor said “On consultation with our senior legal counsel they agree that we should appeal this finding which we believe is totally incorrect”; the appeal will of course enable the online casino to carry on until it is finalised. So it seems that the saga goes on; gambling itself is not illegal in South Africa but just as in the USA they are trying to stop internet gambling which means online casinos.
